Terms of Service

Welcome to Postbro, social media content scheduler. These Terms of Service ("Terms") govern your access to and use of the Postbro service ("Service"). By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Postbro, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Postbro provides tools for scheduling and publishing content to social media platforms, including but not limited to Bluesky, Mastodon, X (Twitter), Instagram, Threads, LinkedIn, Facebook, and TikTok. The Service includes features for content composition, scheduling, team collaboration, and brand management.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Post or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Engage in spam, phishing, or other deceptive practices
  • Attempt to gain unauthorized access to systems or networks
  • Interfere with or disrupt the Service or servers connected to it
  • Use automated means to access the Service without our permission
  • Circumvent any access restrictions or usage limits

5. Content Ownership and Responsibility

You retain ownership of all content you create and post through the Service. By using Postbro, you grant us a limited license to store, transmit, and display your content as necessary to provide the Service.

You are solely responsible for the content you publish through the Service, including ensuring you have the necessary rights and permissions. We do not endorse or guarantee the accuracy of user content.

6. Third-Party Platforms

The Service integrates with third-party social media platforms. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these platforms or any changes they make that may affect the Service.

7. Content Publishing and Scheduling

While we strive to publish and schedule your content reliably, we do not guarantee that content will be published successfully, on time, or without errors. You acknowledge that:

  • Posts may fail to publish due to third-party platform outages, API changes, rate limits, or content policy enforcement
  • Scheduled posts may be delayed or not delivered at the exact time specified
  • In rare cases, content may be published more than once or not at all
  • Formatting, media, or character limits may vary across platforms and may affect how your content appears

We are not liable for any damages, losses, or missed opportunities resulting from failed, delayed, duplicated, or incorrectly formatted posts. It is your responsibility to verify that your content has been published as intended.

8. Subscription and Payment

Certain features require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscriptions are billed in advance and renew automatically unless cancelled before the renewal date.

We reserve the right to change our pricing. Any price changes will be communicated in advance and will take effect at the start of your next billing cycle.

9. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. We generally do not provide refunds for partial subscription periods, except as required by law.

10. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Postbro and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our permission.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTBRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Postbro, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

15. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time. We may also terminate or suspend your access to the Service for violation of these Terms or for any other reason at our discretion.

Upon termination of your account, we will delete your content within 30 days, unless we are required to retain it for legal purposes. You may export your data before termination through your account settings where available.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet or telecommunications failures, third-party platform outages or API changes, cyberattacks, pandemics, war, or civil unrest. During such events, our obligations will be suspended for the duration of the event.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles. For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.

19. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Belgium. For users in the European Union, you may also bring proceedings in the courts of your country of residence.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in class actions or class-wide arbitration.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Postbro regarding your use of the Service.
